We have been asked to complete a W8 form for a Company in the USA. 

We are selling a TV show to them (one of may territories) and they have advised they need this to ascertain level of withholding tax applicable.

is it the W8-BEN i should complete?  And indeed does the UK - US treaty not allow for witholding tax to be reduced to nil for this koind of sale?   They are buying the finished show with no input into how it is made.  In effect they get a licnce to broadcast in US for 3 years.

On the face of it

yes, a W8-BEN, and yes Article 12 says:

Article 12: Royalties

12(1)  Royalties arising in a Contracting State and beneficially owned by a resident of the other Contracting State shall be taxable only in that other State.
