In the HMRC webinar today I am unable to understand why with just 11 days to go too mandation HMRC feel that they need to talk Agents through just the sign up process in such away that HMRC give an impression  Accountant are dim . I was amazed to learn that it seems the AML rules have been ignored by some Accountants since 2009(ten years) ! So, I have paid my AML fee and complied whilst other have gone along not complying breaking the Law of the UK and possibly aiding Terrorists now codoned by HMRC, HMRC publically acknowledging that this is the case and seeming to turn a blind eye as is suits when the rest of us have to "do as we are told" or suffer consequences. I beg the question that these so called professionals should not be allowed to work as a Public Accountant , should pay back dated Fees with interest and also be fined for non-compliance as this would help to plug the Tax Gap !! 16% of Agents are confident about MTD and Lenny Barry said this is good !! I personally think its very concerning. HMRC have become obsessed with making sure no one signs up who is not using MTD compliant software , I would guess this is because their is a good chance they wont get paid and that Taxpayers would have a good excuse to appeal against any surcharge as a result of such a negligent directive and Law. Againg HMRC work in the interest of the offenders whilst the good guys are treated badly.

Most of all nothing was mentioned about how difficult digital records keeping is bearing in mind Agents are struggling to understand how to even set up the ASA.  How mad is that ? Lenny Barry again saying it all marvellous and no need for anxiety !!

In the Q & A notes HMRC say that if you are an Employee of a business then you need to register for AML . I quote from the webinare :

Q: Hi, I submit VAT return as an employee of the client, then do I need a Anti Money Laundering Supervision?

A: Yes, anti money laundering has been a requirement by law since 2009

I thought that an employee was not required to complete AML as the owner was responsible .

It is worrying but please start taking action and stop bearing all the worry for your clients.

The advice is obviously incorrect for the employee. I expect there are loads of self-employed bookkeepers who are not registered for AML just for filing VAT returns. In fact I am not sure if the bookkeepers who file my clients’ VAT returns are registered.

I have an excellent plan for all clients now and its working well(HMRCs favourite term at the moment ) and I always check out the clients book-keepers , infact I am told I give a second to none client service. I am fed up with the professions apparent double standards highlighted now by MTD.

Don’t you have to give details of your AML body to become an agent? Although loads of VAT filers probably use the clients’ logins.

Well done on your plan. For the ones who have bookkeepers who you have checked out then can’t you leave them to it? Or I expect from your other posts it is those without who are the problem.

They are not so much a problem its more I genuinely feel its an unfair ask of HMRC and if we all sit back and say nothing then nothing will change. Even if my posts fall on deaf ears at least I feel I have put forward valuable points on behalf of my clients. The more HMRC get direct feed back the more the "car crash" will have less injury to the passengers ( not my analogy btw ) .
