Maternity leave & furlough claim

Is the 8 weeks notice period always applicable for furlough?

Apologies if already asked amongst the multitude of furlough questions:

According to maternity action - If your employer did not give you notification in writing of the date that your maternity leave would end, you can return to work earlier and you do NOT have to give your employer at least 8 weeks’ notice. This means that you can give your employer a notice period of less than 8 weeks if you want to return to work early.

HMRC gives the basic guidance & advises that employees will not be eligible for furlough until the end of the 8 weeks notice.

So my question is, if the employer did not give written notificiation then the employee could give less than 8 weeks notice but would the furlough claim only be available from 8 weeks after the employee has given notice?

This looks more like a question of employment law. You would be better off trying ACAS. They do have a free helpline

Thanks Paul - I thought it was more of a question about the CJRS rather than employment law but might give ACAS a try

I agree your view that your question is one of CJRS. It raises an interesting point which I have thus far researched a little.

If you would kindly update us, after contacting ACAS (I would be reasonably certain that they will advise you that your question is outwith their field) and after contacting the HMRC Helpline (I currently believe you will initially probably receive the "wrong" answer when you do so) I shall seek to provide a more substantive response.
