Moving a property into a limited company

Stamp duty etc

Didn't find your answer?

I have had conflicting advice from solicitors on this - so any help gratefully received.

Client and partner want to but a house together but client already has a house so secondary residence stamp duty will apply.

If original house is moved into Limited Company (paying over the stamp duty on the value of property) would my client and his partner then be able to claim back the extra 3% stamp duty on their new house as they will only now own one house although my client will then hold shares in his own company which will own his original house.

Any advice gratefully received.
