Nil CIS return late filing penalty

A client has received a £100 late filing penalty for a monthly CIS return. The return has now been submitted and was a nil return. We intend to appeal on the basis the return was a nil return. Has anyone else been successful on this basis?

State the reason as no subcontract payments this month
