Client contacted me today to inform me they have 1 apprentice which they pay £185 a week cash in hand and have done since January. This is news to me.
The client can not afford to pay apprentice until CJRS is set up, does anyone have any advice on this?
I'm reluctant to admit but I think the client will not qualify for the CJRS due to no payroll. Therefore what are the legal implications with paying said apprentice going forward.

So quite simply he's cheated and only forced to come clean now when it suits.
I would say no with emphasis. The rules are quite clear. There was no payroll in existance. In any case you are now morally bound to set up a scheme backdated to the date apprentice started. I really have little sympathy for cheats.

The apprentice.
Cheated out of his NI record.
Cheated out of his furlough pay.
Disengage from this client. You cannot act for this crook.
Possibly - the apprentice will quit. He might say "I'm out"

The guidance is clear; he/she thinks thinks they have pulled the wool over your eyes whereas they have probably shot themselves in the proverbial foot!
Serves them right if there ever was an apprentice at all that is!!
