Office holders and Working Tax Credits

Can officers of a company claim working tax credits

My wife and I have recently created a limited company to design and manufacture leather goods. My wife is the sole director and therefore an “office holder” in the eyes of the tco. I work for her at the moment for free but over 30 hours a week. I currently do not have an employment contract with the company.

As it states on the wtc form that you can claim even if you earn nothing. Does anyone know if we are eligible to claim.

I don't know the intricacies of the application form but when I looked at this in the past you had to be paid minimum wage for the declared hours.

More to the point, if you are not an officer of the company and are working for free then there is a breach of NMW regulations.

I had a similar situation when a husband and wife set up a limited company. They were both office holders. They didn't take a wage or dividends in the early stages of the company but lived off savings and redundancy money. They were refused tax credits because they didn't have employment contracts and weren't paying themselves a wage.
