Original doctor's note - must employer keep it?

Employee has asked for original doctor's note back to try and claim Universal credit

Didn't find your answer?

I think I'm right in saying that as we, the company, are paying SSP and company sick pay we must keep the original doctor's note, as in theory the employee could get a sick payment from the government if they provide their benefits office with the original doctor's note - can somebody please confirm/clarify ? - many thanks

He'd need a form from the employer explaining why they weren't picking up the tab.

What do you mean by "keep" ? Take it off the employee and not give it back ? Or keep it forever for possible inspection at a PAYE control visit ? The answers are different depending on your interpretation of the word "keep".

Who is the note addressed to?

I'd say the addressee has first dibs.

I mean keep it while we are paying SSP. I know we give it back to the employee once we've exhausted SSP (along with SSP1 form)
Managed to get through to Gov helpline and the word is I can take a copy of the doctor's note and send either the original or the copy back to the employee

The GOV.UK site (albeit not known for its accuracy) states categorically that the Employee should keep the original and the Employer can take a copy.

Employees can get SSP from each employer if they are eligible.
