Overlap relief figure from HMRC for BPR?

Struggling to obtain overlap profit figures.

Didn't find your answer?

I have submitted 6 separate client requests for overlap profit figures from HMRC so far. In each case I received their acknowledgement email telling me I would receive the information within 15 working days. Almost 3 months on (in some cases) I am still waiting. A call to HMRC this afternoon revealed that they don't have my online requests, they don't have profit information earlier than 2018/19 for any taxpayer (really?!) and I will need to submit Subject Access Requests in writing to obtain the overlap profit information (but they couldn't tell me how best to do this and exactly what to ask for). Last I heard, HMRC are taking 4-6 months to respond to written correspondence so I'd rather avoid this route if possible - my clients would like their tax returns to be dealt with sooner rather than later. Do any of you have experience of a more helpful response from HMRC?  Should I sit in the 'phone queue for another hour on Monday and hope that I'm lucky enough to get a more helpful person?  What exactly is the point of the online tool to request this information?

Do you have to be logged into the client's PTA for that? Or can you request the figures from within the Self Assessment client list in your HMRC Agent Account?

You just go through security on the webchat, it is like the ADL. Ask for an adviser in the text box.

Many thanks, I eventually managed to knock two on the head this morning! I won't be using the online tool again....

"they don't have profit information earlier than 2018/19 for any taxpayer (really?!)"

That is complete rubbish.

With one or two exceptions they can view any Self Assessment return, right back to the start with the 1996-97 ones.

I've been waiting two months. I applied for one last year and got it within the 14 days, it was well before the year they told you!

I haven't needed to get this from HMRC very often but, on each occasion, they've come up with the goods.

That was, of course, in the days when HMRC was staffed, which, I suspect, is the problem here.

Should imagine there's a delay now as I got in quick when the service started and had all mine back within 2 weeks.

If you really do get no where I'd just use a reasonable guess and let hmrc argue it should it ever come up. After all how would they if they don't know themselves.

On Friday (07.06.2024), I received figures for a request that I submitted on 22.03.2024.

They were able to give me net profit from 1996/1997 and also the net profit from a change in basis period in 2001/2002.

I have no idea who did what way back then, but at least I can now make a stab at some useful figures??

Glad to see it's not just me having delays with this. I submitted my first two requests on 8th April and haven't heard anything back yet. Based on Claudia's dates, I'm now hoping to receive them shortly.

I only put a few more in last week, so won't hold out much hope in getting those back for another couple of months. I'd have put them in sooner if I'd realised they would take this long!

See the comments from Matrix above - I've just managed to get two Overlap Relief figures from a technician via the webchat, both of which I applied for through the online tool on 13 May.

You all seem to be having better joy than I am with this - I braved the webchat for the first time this morning, only to be told that in my client's case there was an adjustment in the second year of trading and so this needs to be reviewed by a Tech Inspector, and I need to submit the G-form. I've already done this a couple of weeks ago, so it seems like it's just the waiting game for me on this one...

I'll try again for my next client and hopefully have better joy!

I am having this problem. My Client commenced trading 1st October 1987. (six months overlap relief ?) . His accounting year end is 30Th Sept.
And he was was in business in 1996/97 and still is .
Needless to say there are no old records.
Here is the question- does he get two lots of overlap relief (one for commencement and the other for introduction of SA in 1996/7?) .

No, of course not. Just the 1997/98 relief. No such thing as overlap before then.

How long have you been acting for this client? Did you not see this day coming?

Sorry if I seem unsympathetic.

I too have not had a single reponse to the overlap queries, probably a dozen or more since the beginning of the year. Will try the webchat as suggested, but that rarely seems to be open in my experience.

Otherwise my inclination is to just put in an estimate for overlap relief, with a note saying it will be amended once I have a reply from them.

Why don't you have a record of it?

Did you not realise that, one day, you'd need to know?
