We sell on Amazon and have recently become UK VAT registered. Amazon have a LU VAT number and since becoming VAT registered no longer charge us VAT on their fees. Before this however they did charge VAT, which we cannot reclaim as we did not pay it in the UK.
Is there any argument that they should not have charged us VAT in the first place? I have read the following on another forum regarding a similar situation:
"Strictly speaking you shouldn’t have been charged EU VAT in the first place as B2B supply of services is taxable where the customer belongs under the general rule, but a lot of companies don’t apply this treatment unless the customer is VAT registered."
Is this accurate? And if so is there any way to get Amazon to refund the VAT payments?
