How many properties is this?

A house has been converted into 3 flats. 

If they are all purchased by an individual and flats 1&2 converted into their main residence to live in, with flat 3 rented out, how does the SDLT work wrt the 3% surcharge?

Did they buy 3 properties then dispose of 1 to themselves for SDLT purposes?

No. They bought three dwellings. End of.

MDR will help mitigate the liability.

If they had bought flat 3 on a different day things may have been different re the 3% if they also replaced their (previous) main dwelling.
