SDLT and sale of property by LLP to LLP partners

Didn't find your answer?

Should SDLT be payable on the sale of 3 residential properties each for £57,500 in 2015 by an LLP to the two partners of the LLP.  Each sale is below the £125k limit and the sales were not on the same day, but spread only over 3 days.

Probably not, but you need to use market value and then apply a sum of lower proportions calculation, in relation to what is transferred to each partner (if they are otherwise unconnected), to determine the amount of taxable consideraion. You do have linked transactions, and if there is a tax liability you might then want to consider MDR.
