Shares and options

Payment in cash?

Didn't find your answer?

I am aware that HMRC take the view that payment for shares must be in cash, although there appears to be no legislative authority for this stance. Does anyone know if a similar view is taken, by HMRC or elsewhere, in relation to a grant of EMI options - ie if one does need to pay cash for the shares, could one instead transfer an asset as consideration for the option?

I don't know where you (or HMRC) are getting that from - SH01 clearly caters for shares issued in return for consideration other than in cash.

Are you thinking perhaps of buybacks, where HMRC (incorrectly) state that payment must be in cash?
