Some help needed please

Concerning off-payroll working

I have never had to deal with IR35 before but I have one client now who has fallen under the new off-payroll working regulations for public bodies. I have done quite a bit of research and reading on this but have a few niggling problems.

Would anyone be able to give me about a quarter an hour of there time, for which I would obviously be happy to pay, to help me out? I use FreeAgent for this client, if that helps.

Once I got my head around it, I realised it's actually easier than "traditional" IR35. Basically the Ltd Co is a simple pass-through. Ignoring VAT (which is no different to non IR35), the total amount invoiced is income, with the PAYE deducted being a cost, and the balance being non taxable salary (also a cost). Therefore profit = £nil.

The tricky bit to my mind is aligning it up with RTI submissions, given the urgency of those, and the delay before you typically receive the "payslip" from the public sector provider. For the last 6 months we've typically been retrospectively changing the payroll each month for these kinds of clients, and just wondering how we'd deal with it come March/April (sod trying to do an EYU for each). However, I gather there's no strict requirement to align the timings of the payroll, so maybe we'll just run them all one month behind.

For the individual concerned, I believe they'll get a P45/P6o as appropriate (or possibly it won't legally be that, but to all intents and purposes will be).

I could be wrong, but it sort of makes sense to me this way.

Thanks for your reply. I thought, on reading the HMRC blurb, that the RTI submissions were made by the "fee payer"; i.e. the public body that is operating the payroll for the PSC.
