I am pleased to say, having got the old data from HMRC under a FOI request HMRC have capitulated entirely, and removed all the tax due, all the penalties and my client has nothing to pay.  

They even say they will write my requested letter of apology. I cant see that getting signed off, but we will see....

If I got a letter of apology out of HMRC, I'd have it framed.

Plus the time costs to encourage or persuade the client to seek recovery of fees, and overcome ( unfounded) fear of HMRC reprisal.

Plus the time costs to prepare the said invoice and covering letter on behalf of the client.
