Our client paid a previous tax adviser to submit a Self Assessment Return.

This return was never submitted and the client has been penalised by HMRC.

The client's position is that having received an invoice for submission of a Tax Return he is entitled to expect that has what has happened.

HMRC are saying that it is the client's responsibility to ensure that the Return is submitted.

Has anyone any experience of a similar case?

Has he signed off the retun?

If a client of ours had paid the invoice but not signed the return we would not submit it until we have the authority.

We would however let them know that it needed authorising.

Receiving an invoice

Does not mean the return has been submitted?  Why would he think that?

Has he signed/authorised the return?

Yes = agent's fault

No = client's fault
