Termination payment for non-resident airline pilot

Is foreign service relief due?

My client flies for BA and is currently being offered early retirement with a large termination payment. His question is "will this be taxable in the UK?".

He has been non-resident for over 20 years so has only been taxed on the proportion of this salary relating to UK duties - usually about 10% of total salary.

I have been researching this, and looking at EIM13690, I think that foreign service deduction will be due but I am not totally convinced.

I am just wondering if any of you have had experience of this and can advise me if the client definitely qualifies for the whole deduction or just a proportion.
