TPR Declaration of Compliance

Dear, I have a problem with filling the declaration of compliance.

In the staging date my company employee 4 people, one of them is at pension age and the rest is opting out. 

How shall I answer on these question:

The number* of staff you had to put into a pension scheme: 4?

The number* of staff who do not fall into the above categories: 1?

Opting out is irrelevant. Nothing to do with the employer or his declaration.

I set up Nest, added all eligible job holders. Then I will send declaration of compliance. But one more question, how can I tick that they are opting out? I just ticked that in my payroll software.

You don't "opt them out". You just enrol them.

Opting out is their decision. They opt themselves out if that's what they want to do. No involvement from the employer in that part of the business.

Just to be clear, the old bloke isn't an eligible job holder. He shouldn't be enrolled, though he may be able to opt in, depending on age.

You complete the declaration of compliance with the eligible workers you have entered in the scheme. You deduct the pension in the first month as usual. If, having sent out the letters, an employee opts out within 30 days then their contributions can be returned to them and you would then update your payroll/pension for future months taking out this employee.
