I've been prevented from claiming the SSP back on 4 employees for a client because 2 of them were not on the payroll on 28th February.
I can't see this anywhere in the legislation or guidance and HMRC webchat checked with his boss so it must be right. All I can see is that the PAYE shceme had to be in place then but it doesn't specify the number of employees.
The claim form will only let you claim up to the number of employess that were on the payroll in February. He had 2 but took on 2 new lads in the summer. All had to self isolate for 2 weeks when one tested positive.
Any ideas on how to pursue this? Or tell me I'm wrong and at least I can point to it when I tell my client it's not just HMRC that are rubbish.

I'd ring the CJRS helpline and asked to be referred to a higher tier. They will probably do the claim manually for you...when they get around to ringing you back!
