what is the status of a determination

HMRC have issued a s 80  determination as part of their attack against a DOTAS scheme. The amount they have determined is substantially less than the tax that would be due if the actual tax calc was done including ll other income. (HMRC have assumed no other income and full PAs). Do we accept and pay or will it come back and get us?

How do we tell HMRC we would like to pay more? Do we appeal and increase the amount paid? The relevant return is under enquiry so could be amended.

Section 28(C)1.

Isn't it just like the old estimated assessments? No legal standing because it only exists until a return is made?

I think..

.. the OP means a Reg 80 PAYE determination.

If so, the tax should be worked out in accordance with the tax code in effect during the year,  If you don't appeal within 30 days it is final.
