The alleged crime is that the CFO received benefits that he should have declared as income. In addition, the company should have paid payroll taxes (the US equivalent of employers NI).

One point that struck me is that the payments may have been made by Donald Trump personally. The defence may be that these were gifts and no deduction was claimed in the accounts of any Trump business. There have been cases in the UK where such defences have been successful.

Their defense so far is is a witch hunt and it is political.

Being a criminal case, the intention was clearly tax evasion. From the public information to date, they do not have a defense that would have a standing in court.

They are are trying to get the public opinion on their side.The end result will be the same. Weisselberg will be convicted. Trump will blame everyone else, including his children, to protect his skin.

They will go for Trump towards the end.
