When does the strike-off process start?

From the date of application or the date of Gazette notice?

Didn't find your answer?

Hi all,

Client is 100% shareholder/sole director of company. Profits available for distribution £20K. Stopped trading 4 months ago. Has applied for strike-off and so CGT treatment will apply on distributions. Hoping to stagger distributions to £10K before 6 April 2022 and £10K after 5 April 2022 (both covered by the AEs).

Strike off applied for online 24/3/22. CH have not yet published their First Gazette notice. Does capital treatment start from 24/3/22 or from the date of publication (which might be after 5 April)? Obviously 24/3/22 preferred so can stagger the distributions as planned, but can't find HMRC's views on it.

think the wording from S1030A(2) "intends to make or has made an application...." confirms the preferred treatment, but would appreciate views, please.

Thanks.

I have always done it on a "if the DS01 is in, its happening" basis.

Be interested to know if I have gotten that wrong.....
