When is a company car available for private use

My employer has a pool car which is habitlually kept on the company premises overnight.  However one employee holds one of the two sets of keys (the other is in the admin office).  Does permanently having one of the two sets of keys mean that the car is "available for the private use" of that employee and therefore has to be declared on his P11d. 

Other employees do drive the vehicle using the other set of keys and it is stored overnight on company premises so in all respects it is genuinely a pool car.

The obvious question is why does one employee hold one set of keys? If it is genuinely a pool car, there is no immediately obvious reason for them to do so.

I have no idea. I only found out this morning that he does. However, I can confirm that it is genuinely a pool car. I see it in the car park every day, I and others drive it, and I see the employee arrive and leave in his own car.

Until you can answer stepurhan's question then there is not much more to be said. One employee having a set of keys does not preclude the car from being a pool car, but I would want to know why before making that call.

Is it because he is responsible for maintenance? Does he just happen to use it more than anyone else so keeps one whilst everyone else uses the 'spare'? Is he just inherently lazy and cant be bothered to go get the key? Did he have a sordid affair with one of the admin girls (or guys) and now they cant look each other in the eye? Does he keep the key in his desk, or take it home with him? Does he live next door to the office, or within a reasonable walking distance? Is there a mileage log? Does his contract prohibit unauthorised private use? Have you noted the position of the valve caps on a Friday to see if the car has moved over the weekend? Are you interested because your job includes the P11Ds, or are you just unhappy that he has his 'own' key?

Some of the above might be important, and depending on the answers, others might become more, or less, important.

Personally I reckon he's been skimming the tea kitty and doesn't want to return to the scene of the crime in case hes rumbled
