My client received a letter saying she needs to complete a declaration of compliance.  She is a contractor with a Limited company and no employees

Can she just complete not an employer link instead ?

I never received such a letter and a sole practitioner  Other sole director clients have not received a letter as well.  Not sure why she would have received a letter being s single director.

She can complete either or you can, it may come in useful for next time.

It is completely random, some single Director payrolls are identified as such and never receive a letter reference, others have to complete the declaration. I expect now that the staging date is immediate, the letters will be more common since there has been no RTI history.

You say that none of your clients have received them - do not take their word for it, I look every client up and check since the penalties are huge.

Thanks Matrix. Is there a £400 penalty for late filing even if there are no employees in the company ?

If a declaration was required but not submitted then I imagine that having no employees is irrelevant. The penalty would be issued, do a search here to see if there have been successful appeals based on the same fact pattern.
