HMRC discretion to refund overpaid inheritance tax- is it likely?

Hello, we have overpaid IHT instalments, with a property being held with the intention the eventually pay. So one tenths are being paid every year, but (on behalf of Trustees) we overpaid these instalments.

We now realise that funds are needed to meet ongoing matters in the Estate, and have requested a partial refund from HMRC (just of the excess payments, not the due instalments). I know they would refund if the property at the point the property is sold, but this is not the case here. Apparently, it is 'at their discretion', but we have not heard back.

Has anyone else had this situation, and how far does HMRC's discretion prevail?
