Client (ltd co) runs their auto enrolment pension scheme through Nest.

The company also makes pension contributions for one of the directors into their personal pension.

The pension advisor has invoiced £190 to the company for their annual review in respect of the director's pension.

Is it correct that only £150 is allowable as a company expense - or is the £150 only tax allowable if all employees are offered the same advice? 

Does the £190 create a benefit in kind for the director?

Best way to "learnvfast" is by researching your own answer which others can then critique.

Reading EIM 21803 pension advice upto £500 per year would be allowable - subject to conditions A or B.

Reading condition A - it would appear that the director's pension scheme is not available to all employees generally so would fail on this point.

The full amount would then be subject to a p11d but allowable for tax purposes.
