Enterprise Management Incentives (EMIs)

The announcement today that the employee limit will increase from £120,000  to £250,000 makes EMIs even more attractive for private trading companies.  This change will be introduced by way of a Statutory Instrument as soon as possible.  Even better is the intention to give entrepreneurs’ relief (ER) to employees triggering capital gains on exercise.  The proposed ER changes will be included in Finance Bill 2013.

Paula Tallon , Gabelle LLP says “the proposal to allow employees to benefit from entrepreneurs’ relief on the gains arising on exercise of enterprise management incentives (EMI) share options is welcome.  It is a shame that it is delayed to 2013 however there is an opportunity for companies to incentivise employees with the prospect of a 10% tax rate”.
