No, its not a caravan, its some form of 'modular' building that is designed to moved if need be.
And yes, you've just answered my question, as its being treated as plant for CA's purposed then the rental is of plant and not land & property.
Sometimes you just need someone to point out the obvious!! Thank you
So, getting back to my original question, does anyone know is the a double taxation rule for UK National Insurance and ROI PRSI like there is for UK tax and ROI tax, or that just wishful thinking on my behalf?
appreciate all your replies.
The foreign income is the income from self employment earned in NI, my understanding is if they live in ROI they have to declare all their income on their ROI tax return?
Same way if you lived in NI and worked in ROI you're supposed to fill out a UK Tax return declaring the foreign income earned.
Am I wrong?
Thanks for your replies,
They have a PE in NI, I submit a UK Tax return for trading profit made in UK and also a ROI Tax return for foreign income brought into ROI. So far no tax due yet as below the threshold in both countries but at least I know they will get foreign tax relief in ROI for UK tax paid. But they were above the threshold for Class 2 NIC's in UK.
My main problem is when I filled out their online ROI Tax return showing foreign income received because its above €5000 they have to pay PRSI (4% on income subject to a minimum of €500).
So is there a rule for double payment of NI & PRSI?
In my case they ask specifically about the employment expenses.
It does say if you feel the claims are correct then there's no need to contact them.
What rights do they have to open a discovery enquiry?
No, it went straight to my client
Sorry, I am an accountant not a lawyer.
I have never had this query before and just assumed holiday pay was based on normal average weekly pay (and now it can even include overtime).
So my query was to any accountants out there who might have come across this situation in their practice and there was some small point that I might have be missing.
Maybe this is not the correct place to ask this question.
