Good article. Re the comments, people need to stop over simplifying this. The issues here are: The law here wasn't clear - if it was, the loan charge wouldn't have been needed. Going back 20 years even where the contractor has been intentionally misled is disproportionate. HMRC's DOTAS scheme made selling the arrangements easier but they didn't close it - and now they say the same schemes never worked. Why register them then? The loan charge is indiscriminate and disproportionate. If MPs didn't debate it enough at the time, that doesn't mean it shouldn't be exposed now.
