I've never requested Employer refunds by post, always through the Employer helpline, but agree usually it takes many many months to be paid to the client (not always though, they have surprised us on occasion)
I believe you need to speak to the Employer helpline and beware, I've tried 3 times to get through this week and warned of 1 hour wait times. I couldn't get in the queue to hold the first 2 times, then I did indeed wait longer than an hour to speak to someone.
Yes in April the lookback will be to April 2019 v 19/20 for variable pay. The Direction always comes from HMT as it's their direction to HMRC under powers in the Coronavirus Act
I wonder if April 20 pay is higher (maybe they weren't furloughed until later in the year) if we can use that?
Ive just checked and these employees were furloughed on 19 Match, so for now I'm going to divide their March pay by 18 x 31 for March reference pay. They were fully furloughed in April, so not sure what the situation will be then other than using April 19 gross pay, if available, or the average if 2019-20.
Sorry to hear of the email you received! Unnecessary in my opinion. Sounds like you contacted CJRS helpline initially, was your question not passed onto a higher tier to investigate and reply to you? We had a few clients where we couldn't make a claim (different circumstances than yours) we rang and was referred to a higher tier and had to chase a few times. This was back in April, probably took around a month for them to call us back and resolve it.
Thanks Barbara. Yes this is exactly it! Took me a while to fathom out. Plus of course some may no longer have the credit on their PAYE account as they are in arrears or they have access to their PAYE account and have reduced their payment already rather than paying what we advised.
Luckily we've had no normal overpayments so far that clients have had to pay back, so it's good to know the process. Thanks

Great, thank you, I've missed the new direction. So assume then that April furlough will use April 2019 gross pay (if applicable)

Well yes I agree with hindsight. Too much going on at that point, plus it seemed to clearly say that the EA would be adjusted.
I bet it will be use whatever they would have been paid that month if not furloughed....what about variable hours employees though?
