If the loan term on the scheme was, for example, 20 years, it doesn't make much sense to take the position that "the loan was always repayable so just repay it early if you want to avoid the upcoming charge"?

I think it's easy for tax professionals to sit back and blame the greed of people who get involved in these schemes. My guess would be that the promotor of this scheme claims it is not notifiable under DOTAS either. And, as a contractor in a high-risk sector, I receive several e-mails from various promotors of similar schemes every week.
APN under DOTAS What surprised and concerned me is the changes allowing for an APN to be used for an agreement disclosed under DOTAS - it seems that the DOTAS scheme is being twisted into something it was not intended for. The end result will be to push avoidance schemes underground, finding reasons not to declare.
