I'm no expert in benefits - I think things like pension tax credits and council tax reductions are means tested. I would speak to their social worker who should be able to advise what is available to them.

Are you sure that the competitors are talking about employees and not subbies? You mention their vans that they sleep in - surely these are company vans if they are employees and therefore they wouldn't be entitled to travel allowances and possible benefits in kind implications. Could the competitors be paying travel and hotel allowances to subbies and not including them in the CIS deductions? Its still not right if that's the case and whole different discussion, It could be your client has got the wrong end of the stick.

Could these people be seeking to get round their professional bodies rules about PC's. The op mentions that they are advertising through Facebook using their partners names, could they be their partners "employees" or acting as a "consultant" to their partners businesses. I know this is very unlikely to be the truth and shows that they are looking for ways round getting a practice certificate. They might get away with it, we don't know which body it is so don't know what the line is if they are not the principle of the business. I agree with the others you still need to report them.

I think your potential client is missing something, namely not spotting what a bargain he is getting! I can't see how the present accountant is filing under MTD without doing some sort of book keeping. The client is saying he's not doing it so someone must do it for the accounts.
Is this client using the flat rate scheme - in which case if there are only a few entries for income on a spreadsheet and the calculation for the flat rate, which is then run through third party software that could explain it. As Paul said I hope that the £120 a year charge doesn't include the accounts as well.

No that is the point Lion is making - there is no new guidance for accommodation landlord suggests he is renting a property. Irrespective of that your client is charging the council his usual 20% because it part of the service he is providing.

Good point - I misread that will teach me. I took it that accommodation was a hotel because of the mention of 5% VAT rate. I've re-read and noticed the word "landlord".

No because your client is invoicing for his services including the accommodation charge to the council its still 20%. He will pay the 20% over to HMRC as normal because he isn't running a hospitality business. If he only paid 5% VAT for his accommodation he will only claim 5% back from HMRC.

I realise I'm late to the party on this my thoughts on this one from your description of the scheme are..
Its a very strange scheme - why doesn't your employer not have either a "normal" company car scheme or send its employees to the lease company to offer them a discounted rate. The employee pays the lease company direct and cuts out the employer all together. I can't see what the employer is adding to this.
I would be suspicious of any scheme that comes with a 25 page document that the employee is struggling to understand and basically says the employer has no responsibility for anything.
I also think that there may be a benefit in kind as per Apollo Motors but as others have said without reading the whole document I can't be certain. You also mentioned that insurance is paid by your employer.
You've said you are working in the Public Sector - are you a member of a trade union? You can't be the only employee that can't make head or tail of what the scheme entails. Can you speak to your union rep - unions often have their own solicitors. They perhaps need to read over this document and give their view as to how it would impact on its members?
