It is important to remember that a "dilapidations" claim is a claim for damages which are properly recoverable at law as a consequence of alleged breach of contract.
Property can involve substantial risk and for both landlords and tenants a proactive strategy should be adopted in relation to the identification and management of such risks and given that dilapidations is a claim for damages then the start point should be a legal appraisal. Building surveyors and valuers can then be instructed as required.
