Usually unless they're insolvent or don't give a damn about legal action.
We usually get payment from people who think they can run rings around or ignore our clients. For commercial (B2B) debts, under Late Payment legislation costs and late payment interest can be added too, so no cost to you.

Taking that one step (pun intended) further, if you were off sick with the broken leg, you wouldn't expect them to call up and ask you to walk somewhere.

As it's a business, the minimum for a Statutory Demand is still £750. The increase to £5,000 only applies to individuals. That said, you need to be sure it is going to worry them sufficiently to make them pay as to follow it up with a Winding-up Order can cost several £000's.

If the bank had asked for a personal guarantee, they should have provided documents that should be counter-signed by the OP's solicitor, who will have explained what he was letting himself in for. As he has hasn't mentioned this, I suspect he hasn't entered into a PG and someone at the bank is just trying it on.
