No income at all for his wife though joint claimant. Reviewed award claims when I met with my client yesterday. It appears that year on year the pension income has been included in the employment income section but there is no reference to self employment at all.
It's all rather strange not sure under what criteria he's received the award and then why they have now stated "change of circumstance" to claim there's been an overpayment.
I think we are going to write to TCO and ask for a simple explanation at the outset as frankly I am stumped. Shouldn't TCO explain these things rather than simply issuing award notices and overpayment demands.

He's on his way in to see me now and I am so very annoyed that I did not make more of a fuss about this beforehand, as it is so simple to rearrange things to include a salary - which would have also removed the modest corporation tax liabilities. I should have been more forthright but he insisted he had dealt with it over the phone with TCO. It's only now that there is an issue where I am starting to feel a change in tone.
Kirkers, it will cause hardship and it will be tough without the tax credits let alone the fact that they will have to start repaying them from any new claim. To be fair it looks as though they have only gone back 2 years and if we make more of an issue from it, perhaps recourse will go back further.
David, I tend to agree. How sure can he be that he did give correct info in 2007? He seems to be but I will put this to home shortly. I just don't want to make things worse than they already are.
All of the figures provided on the renewals clearly state the correct income details as per his Tax Return.
Appreciated spidersong. I thought as much; appear to hit a dead end with these situations; it's not so much that HMRC can't help its the attitude that they won't help or won't point us in the direction of the person who could help.
Surely it isn't impossible in such a situation to delete a Return and reissue, particularly in exceptional situations which I feel this genuinely is.
Our problem is that the original change of vat details form was posted, not sent recorded and so as far as they are concerned it is our problem - which it is!

If you don't mind - I have a second question relating to this. Is it possible to extend the year end in order to avoid the requirement for audit? With this company, total assets three months after the current year end, due to sale of some of the assets below NBV, would mean the company was way below the threshold at the extended period year end. I am assuming it is likely this is not a possible strategy, but they have asked me and to be honest I am just not sure.
Problem being the directors struck off the company voluntarily so I don't think we'll manage to apply for an administrative restoration; think it has to be by court order? Is this the case?
