I had cause to call adviser helpline on another matter, another c 40 minute wait. This was to do with correcting a client DOB identity error, which should have been a simple matter. No such luck, I was told to write in with two forms of certified ID and advised it would take c 9 weeks to receive an actioned reply on such a simple matter. I despair at such appalling bad service. As far as I am aware HMRC have the same number of staff, albeit working from home, so why the COVID excuses and restricted hours. I was told the service was closed on Saturdays despite being advertised as part of their normal service week. In the meantime the client cannot submit a 30 day CGT return following sale of a property as HMRC system will not recognise him despite me doing his SAE for the past 10 years!
I had to hold on for 40 minutes to speak to someone on the Agent's help line yesterday, but am not blaming the adviser, he was very good when I finally got through, fortunately I was able to carry on with other work whilst waiting, but what a dreadful service for something claimed to be a preferential service.
I have had an employee for the past 15 + years who is paid a small amount annually in March, so plenty of PAYE history, annual returns etc, my claim is being refused, I suspect this is the same for many small business employees.
It is about time that tax avoidance schemes devoid of sensible commercial justification are outlawed so as to protect the rest of the legitimate tax payer classes and the overall tax base.
The key thing is to have a buddy or two you can talk to whether a life partner or a professional colleague/friend/mentor. Amazing how talking things through with another intelligent being will help put things in context and enable a sensible plan to be drawn up to deal with the pressures, whether too much or too little work. We all know how to eat an elephant.........., it is the same principle.
This needs to be appealed to the highest possible level to ensure the legal decision is based on the correct interpretation of current law, the numbers involved should ensure this is cost effective and happens shortly.
If HMRC does not like this then they should petition for a law change rather than rely on poor Court decisions.

How does this apply to a sole trader individual, ie not a Company, employing just one person, do they still qualify for the allowance?
